GENERAL TERMS AND CONDITIONS OF RENTAL


ARTICLE 1 – RESERVATION
A reservation becomes firm only upon receipt of a 30% deposit of the rental amount, which is non-refundable if the client cancels the booking (Article L114-1).

ARTICLE 2 – BALANCE PAYMENT
The remaining balance of the service must be paid no later than 48 hours before passenger boarding, via check, bank transfer, or cash (no credit cards) (download the bank details). The pilot reserves the right to cancel the cruise if the payment is not made before departure.


ARTICLE 3 – INSURANCE AND LIABILITY
Les Croisières Burdigala declares that it is duly insured with a financially sound company for civil liability, particularly in cases of food poisoning and for passenger transport by water. Les Croisières Burdigala reserves the right to charge the Client for any damage to equipment caused during the service by the Client or a member of their group. Any claim made by a Client may be proportionally limited if the damage results from the Client’s failure to observe safety rules set by Les Croisières Burdigala and its employees, without prejudice to general limiting and exempting legal clauses. Except in cases of gross negligence or intentional fault, it is expressly agreed that under no circumstances will the financial consequences of Les Croisières Burdigala‘s liability for material damage exceed the sum of one thousand euros (€1,000). The shipowner is not responsible for the loss or deterioration of valuable items, money, securities, or jewelry.

ARTICLE 4 – INVENTORY AND CONDITION REPORT
At the owner’s discretion, an inventory may be requested and prepared jointly. This inventory will be signed by both the tenant and a representative of Les Croisières Burdigala upon arrival on the boat. This inventory will serve as the only reference in case of a dispute regarding the condition of the boat.
The cleanliness of the boat upon the tenant’s arrival must be noted in the inventory. The cleaning of the premises is the responsibility of the tenant. The tenant has the option to hire someone to assist with service and maintenance.


ARTICLE 5 – SECURITY DEPOSIT
A security deposit of €1,000 may be requested upon arrival at the boat. After the final condition report is made at the end of the cruise, this deposit will be refunded only if no damage is found. In case of damage or missing items, the security deposit will be used to cover these costs (Article 2011 of the Civil Code).

ARTICLE 6 – CANCELLATION BY THE SELLER
Les Croisières Burdigala reserves the right to cancel a service in case of circumstances that may pose a risk to passengers (such as a storm or mechanical failure). In such cases, the client will be refunded the full amount of the deposit paid.

ARTICLE 7 – CANCELLATION BY THE CLIENT

30 to 16 days before departure: The 30% deposit is non-refundable.

15 to 8 days before departure: 50% of the rental price will be charged.

Less than 8 days before departure: 100% of the rental price will be charged

ARTICLE 8 – TIMING
The agreed-upon time cannot be exceeded without prior agreement. Any time spent at the dock before or after the cruise will be charged at €200 per hour (including taxes). Time for installation, unloading, and cleaning must be included within this time slot.
